Woman sues Ford Motor company under a Park-to-Reverse theory; “Popped out of gear”; Ford Truck
The following statements and content reflect those claims made by a plaintiff in her lawsuit
against Ford Motor Company. The plaintiff claims that she suffered horrific injuries when she was crushed by a defective and unreasonably dangerous 2007 Ford F-250 XLT Super Duty. The plaintiff claims that she was driving home to Winnie, Texas and traveling eastbound on IH 10 East near mile marker 222, 10.2 miles east of Saragosa, Reeves County, Texas. She claims that it was during that drive home that she decided to switch drivers with her adult daughter. The plaintiff claims that she pulled over to the paved shoulder of the road, carefully and slowly and then stopped.
The plaintiff claims that she placed the truck in what she believed from the truck’s
cues and the feel of the truck to be “park,” and pulled her foot off the service brake, so that she could exit the truck. Before exiting the truck, the Plaintiff unbuckled her seatbelt and turned around to see if there was any coming traffic. Then the plaintiff opened the truck door, grabbed the door handle with her left hand and the window frame with her right hand and then stepped out of the vehicle. Her left foot and then right foot touched the ground. After the plaintiff’s feet touched the ground, the truck began to move backwards and the truck door came right at her. Unable to move around the rapidly approaching door, the plaintiff fell backwards. Unfortunately, the truck overtook her. The truck wheel came at her as she fell towards the ground. The wheel caught the plaintiff’s right foot. She saw and felt the wheel of the truck run over her right leg, right thigh, her chest and all the way up over her right shoulder; her leg, chest and shoulder sustained the entire weight of the truck. Seeing the wheel was coming right at her head, the plaintiff was able to just turn her head to the left enough that the tire did not run over her face. Had the tire hit her head, the plaintiff’s would be dead today.
The plaintiff medical condition was so severe that she sustained numerous internal
injuries including but not limited to nine broken ribs, five thoracic vertebral fractures, tissue damage and nerve damage the plaintiff injuries also included two and a half liter hematoma, a punctured lung and permanent disfigurement.
Since the day of the accident, the plaintiff has had to endure the painful and slow
process of ongoing recovery. For a period of time after the accident, the plaintiff was unable to work in her job as a surgical nurse with Texas Orthopedic Hospital. The plaintiff has been and is still in daily physical pain as a result of her injuries and will most likely continue to seek medical care and attention. The plaintiff’s injuries are so severe that she anticipates that she will be forced to quit her job due to the excruciating pain she endures when standing and working on the job.
